Acceptance of Terms
These Terms and Conditions ("Terms") govern your access
to the Jiya Web Solution website and your purchase or use
of our website design, web development, software
development, mobile application, digital marketing,
domain, hosting, maintenance, and related IT services.
By visiting our website, requesting a quotation,
approving a proposal, making a payment, or using our
services, you confirm that you have read, understood,
and agreed to these Terms.

Our Services
Jiya Web Solution may provide services including, but not
limited to:
- Website design and custom web development.
- E-commerce website and online store development.
- Software, CRM, ERP, billing, and business automation solutions.
- Android, iOS, and progressive web application development.
- SEO, digital marketing, social media, and advertising services.
- Domain registration, website hosting, email, SSL, and maintenance.
- Technical consultation, support, customization, and integration services.
The exact services, features, technology, timeline, and
deliverables will be described in the quotation,
proposal, invoice, service order, or written agreement
accepted by the client.

Quotations and Project Scope

Quotations are based on the information and
requirements supplied by the client at the time of
estimation.

A quotation may remain valid only for the period
stated in the quotation or proposal.

Features, pages, integrations, content entry, design
changes, or services outside the approved scope may
require additional cost and time.

Verbal requests will be considered part of the
project only after written confirmation by email,
WhatsApp, proposal, invoice, or another recorded
communication.

Client Responsibilities
The client agrees to:

Provide accurate project requirements, business
information, content, images, logos, credentials,
approvals, and feedback within a reasonable time.

Confirm that all supplied text, images, trademarks,
videos, databases, and other materials may lawfully
be used in the project.

Review work, test completed features, and report
issues during the applicable review or support
period.

Keep account credentials, passwords, hosting
access, API keys, and administrative information
secure.

Use the delivered website, application, software,
marketing account, or hosting service legally and
responsibly.

Payments and Billing
-
The project payment schedule will be stated in the
quotation, invoice, proposal, or service agreement.

Work may begin only after the required advance
payment has been received.

Remaining payments must be completed at the agreed
milestones and before final delivery, transfer,
publication, or release of source files, unless
otherwise agreed in writing.

Third-party fees, taxes, payment gateway charges,
domain fees, hosting fees, premium plugins, licenses,
advertising budgets, and API usage charges may be
billed separately.

Jiya Web Solution may pause work or suspend services
when an invoice remains unpaid beyond its due date.

Revisions and Change Requests
The number and type of revisions included in a project
depend on the approved proposal or service package.
Revisions must remain within the original project scope.
New pages, redesigns, additional modules, changed
workflows, new integrations, repeated content changes,
or requests made after approval may be treated as
additional work and may require a revised quotation.

Delivery, Testing, and Delays

Estimated delivery dates are based on the project
scope, timely payments, and timely supply of content,
feedback, access, and approvals.

Delays caused by the client, third-party providers,
hosting companies, API providers, app stores,
payment gateways, government services, force majeure,
or circumstances outside our reasonable control may
extend the delivery schedule.

The client is responsible for reviewing and testing
the delivered project before final approval or
public launch.

Domains, Hosting, and Renewals

Domain, hosting, SSL, email, cloud server, and
related services may require recurring renewal fees.

Renewal reminders may be provided as a convenience,
but the client remains responsible for ensuring
payment before expiry.

Jiya Web Solution is not responsible for loss of a
domain, website, email, data, ranking, or service
caused by late renewal, account suspension, policy
violation, or third-party provider action.

Hosting resources, storage, bandwidth, email limits,
backups, and server access depend on the selected
package or provider.

Third-Party Services and Integrations
Projects may use third-party services such as payment
gateways, social media platforms, WhatsApp services,
Google services, analytics tools, maps, APIs, plugins,
themes, hosting providers, app stores, SMS providers,
email providers, or external software.
These services are governed by their own terms, pricing,
policies, approval requirements, usage limits, and
availability. Jiya Web Solution does not control and
cannot guarantee the continued operation of any
third-party service.

Intellectual Property

The client retains ownership of lawful content,
trademarks, images, data, and materials supplied by
the client.

Upon full payment, the client receives the rights to
the final project deliverables described in the
approved agreement, subject to third-party licenses.

Pre-existing code, reusable modules, frameworks,
libraries, tools, development methods, templates,
and internal systems owned by Jiya Web Solution
remain our property unless expressly transferred in
writing.

Third-party themes, plugins, fonts, stock media,
software, APIs, and libraries remain subject to
their respective license terms.

Unless confidentiality or a separate written
agreement prevents it, Jiya Web Solution may display
completed work in its portfolio, proposals, or
promotional materials.

Confidentiality
Each party agrees to take reasonable care to protect
confidential business information, passwords,
credentials, documents, customer information, and
non-public project details received from the other
party.
Confidential information may be disclosed when required
by law or when reasonably necessary to approved
employees, contractors, or service providers involved
in delivering the project.

Cancellation and Refunds

Advance payments, consultation fees, setup charges,
third-party purchases, domain fees, hosting fees,
license fees, and completed work are generally
non-refundable.

When a client cancels a project, the client must pay
for work completed and expenses incurred up to the
cancellation date.

A refund, credit, or partial refund may be considered
only when specifically stated in the quotation,
service policy, or written agreement.

Advertising spend, payment gateway fees, taxes,
third-party subscriptions, and external service
charges cannot be refunded by Jiya Web Solution.

Warranty, Maintenance, and Support
Any included bug-fix, warranty, maintenance, or support
period will be stated in the applicable proposal,
package, invoice, or agreement.
Support does not automatically include new features,
redesigns, content entry, third-party changes, malware
removal, server migration, compatibility changes,
recovery from client modifications, or problems caused
by external services unless expressly included.

Disclaimer and Limitation of Liability
We aim to provide professional and reliable services,
but we do not guarantee uninterrupted operation,
permanent search ranking, guaranteed advertising
results, guaranteed sales, complete security, or
error-free third-party services.
To the maximum extent permitted by applicable law, Jiya
Web Solution will not be liable for indirect, incidental,
special, consequential, or business losses, including
loss of revenue, profits, data, reputation, customers,
ranking, or service availability.
Where liability cannot legally be excluded, our total
liability relating to a specific service will not exceed
the amount paid to Jiya Web Solution for that specific
service during the period giving rise to the claim.

Suspension and Termination
We may suspend or terminate work, hosting, support,
access, or other services when:
- Payments remain overdue.
- The service is used for unlawful, fraudulent, abusive, or harmful activity.
- The client violates these Terms or third-party provider policies.
- Continuing the service creates a security, legal, reputational, or technical risk.
- The client does not provide required information or communication for an extended period.

Governing Law and Disputes
These Terms will be governed by the applicable laws of
India. The parties should first attempt to resolve any
dispute through good-faith communication and negotiation.
Subject to applicable law, courts having jurisdiction
over Malda, West Bengal, India will have jurisdiction
over disputes relating to these Terms or our services.

Changes to These Terms
We may update these Terms and Conditions to reflect
changes in our services, business practices,
technologies, pricing structure, or legal requirements.
Updated Terms will be posted on this page with a revised
"Last updated" date.
